TERMS AND CONDITIONS

General Membership Terms & Conditions

In consideration of Melbourne Stars registering you as a member, you agree to be bound by the following terms and conditions which apply to all members of Melbourne Stars. The completed Registration Page forms part of these terms and conditions.

1. Definitions

"Cricket Australia" means Cricket Australia (ABN 53 006 089 130) of 60 Jolimont Street, JOLIMONT, VIC 3002.

"Member" means a person who has joined and paid for a membership with Melbourne Stars.

"Melbourne Stars" means Melbourne Stars (ABN 48 152 852 278) of PO Box 327, EAST MELBOURNE, VIC 8002.

"Registration Page" means the sign up page for membership of Melbourne Stars on gostars.com.au or such other membership registration page completed by you at the request of Melbourne Stars.

"State Associations" means a state association member of Cricket Australia.

"You" or 'your' means the individual who is named in the completed Registration Page which is completed on-line at gostars.com.au or received by Melbourne Stars via mail, fax, email or in person.

2. Membership

Membership of the Melbourne Stars is open to individuals and families (including employees of Melbourne Stars). All Melbourne Stars memberships are transferable.

Melbourne Stars will not process any registration that has not completed the mandatory fields where indicated on the Registration Page.

Melbourne Stars has the right to accept or reject any registration for membership of Melbourne Stars at its sole and absolute discretion (and is entitled to reject registration even after payment has been processed and confirmation of membership registration has been provided. In the event rejection occurs after payment is received, Melbourne Stars will refund the relevant membership fee to the applicant).

If you register:

on-line for Melbourne Stars membership at gostars.com.au, your registration will be successful if a confirmation message appears on your screen informing you that you have been registered;

via mail, email, fax or in person for Melbourne Stars, you will receive a membership welcome pack in the mail from Melbourne Stars and a welcome email if you have supplied an email address on your registration form.

Once you have successfully registered for membership of Melbourne Stars, you will be entitled to the benefits of the membership type you have purchased from Melbourne Stars, as outlined in the membership section of gostars.com.au and as advised by Melbourne Stars from time to time.

If your membership is registered on the basis that you are to pay your membership fee in instalments, then if any instalment payment is declined twice, Melbourne Stars may suspend any benefits of membership including cancelling your membership card barcode for such period as any instalments remain outstanding.

You agree that Melbourne Stars may send you a range of cricket-related information, news and promotional marketing material (including by way of mail, email or sms).

If you have previously unsubscribed from Melbourne Stars communications, you agree that by purchasing a membership you will be resubscribed to these communications.

3. Privacy and terms of use of Melbourne Stars website

The personal information which Melbourne Stars collects on the Registration Page is used for the purpose of processing your request for membership of Melbourne Stars. Melbourne Stars may also use your personal information in the manner set out in Melbourne Stars privacy policy. To view Melbourne Stars privacy policy, go to gostars.com.au.

The personal information which Melbourne Stars collects on the Registration Page will be disclosed to Cricket Australia in accordance with Cricket Australia's privacy policy.

At any time that you enter Melbourne Stars web site (melbournestars.com.au or gostars.com.au) you agree to be bound by the terms governing use of the web site which are in force at that time. To view the terms of use of Melbourne Stars web site go to melbournestars.com.au.

4. Membership Refunds & Cancellations Information

Refunds

Full refunds of season reserved seating may be offered at Melbourne Stars discretion however full refunds will not be available after the commencement of the Big Bash League season.

Cancellations

Cancellation of an application will be accepted providing the application has not already been processed. A request for any such cancellation must be provided in writing to Melbourne Stars.

Melbourne Stars may cancel your membership of Melbourne Stars at any time in its sole and absolute discretion. Melbourne Stars is not required to give any reason for any such cancellation.

Transferred Matches

The Big Bash League reserves the right to transfer scheduled home matches from the Melbourne Cricket Ground (MCG) to another venue. A "first-in-basis" seating area or equivalent reserved seat will be allocated to all patrons who hold a reserved seat at the venue from where the match was transferred.

No Result

Melbourne Stars members may be eligible for a 20% discount off their BBL|06 membership if there is no result during any of the Melbourne Stars home games during BBL|05. This discount is only eligible if:

  • less than 15 overs were played during the whole Match; and
  • there was no result recorded in the Match.

Members will only be entitled to this discount if they renew for the following BBL|06 season. The discount is capped at 20%, so if multiple home games have no result, then only a total of 20% will be subtracted from their BBL|06 membership fee.

This is applicable for Stars’ home games only, not for away matches or for any Finals matches.


Cancellation of member communications

Members may remove themselves from any member mail, email or SMS communications at any time by following one of the following options:

  • following the relevant unsubscribe instructions contained in any electronic communication which you receive from Melbourne Stars;
  • writing to Melbourne Stars at PO BOX 327, EAST MELBOURNE VIC 8002 to the attention of "Memberships" requesting cancellation of any email, SMS or mail communications; or
  • emailing Melbourne Stars at members@melbournestars.com.au requesting cancellation of any email, SMS or mail communications; or
  • contacting the Melbourne Stars contact centre on 1300MELBSTARS. Melbourne Stars may take up to 7 business days to process this request.

5. Access to Tickets for Finals for Melbourne Stars Members

KFC T20 Big Bash League Semi Finals

If the Melbourne Stars qualifies to participate in a match which is deemed by Cricket Australia to be a semi-finals match ("Semi-Final Match") and if Melbourne Stars is the designated 'home' team for a Semi-Final Match then certain Members shall be provided with the opportunity to obtain a ticket during a priority access period.

Any tickets remaining (if any) at the conclusion of the priority access period will then be made available to the general public.

The details of the priority access period, including dates, times and requirements will be communicated to those certain Members via email in the lead up to this period. Please be aware that there shall be a very short timeframe between the final home and away matches and the semi-final matches, so Members should ensure they check their Melbourne Stars communications regularly for details and updates.

KFC T20 Big Bash League Final

The details of the priority access period (if any), including dates, times and requirements will be communicated to certain members via email in the lead up to this period. Please be aware that there shall be a very short timeframe between the Semi-Final Matches and the Final Match, so Members should ensure they check their Melbourne Stars communications regularly for details and updates.

Stadium Redevelopments

Melbourne Stars is not obligated to notify members of any proposed redevelopment which may impact upon member's season seating. Should the MCG be undergoing redevelopment availability and access to season seating may be reduced.

Melbourne Stars reserves the right to reclaim seating during a re-development as required. In such instances Melbourne Stars would endeavour to relocate/offer alternative seating (subject to availability) to affected members at its discretion.

7. Concession Membership Policy

Any member eligible for or considering a concession membership MUST provide a copy of their concession ID or produce their concession ID at the point of purchase.

Valid concession types are as follows:

  • Full time Australian Student Cardholder. Must have photo ID;
  • Department of Veteran Affairs & TPI;
  • Commonwealth Senior Health Card;
  • Pensioner Concession Card

Student concession types include:

  • Full time Secondary School Students' and
  • Full time Tertiary Students.
  • Tertiary Student identification MUST state that the student is full time. If not, the student must provide supporting documentation from the enrolled school proving full time status.

Who is NOT eligible for concession?

Dependants listed on a pension card are NOT eligible for concession membership unless they hold their own pension card. The person issued the pension card is the only person eligible for a concession membership.
Eligible concession cards that expire during the Big Bash League season.

IMPORTANT CONCESSION INFORMATION

Concession members MUST produce their valid concession card along with their concession membership to gain entry to all stadiums. If the member is no longer eligible for a concession during the Big Bash League season, the member will be required to upgrade to a full Adult membership.

Members who have purchased an Adult Membership and later obtain a valid concession card cannot downgrade their membership to a concession prior to or during the Big Bash League season.

Concession memberships purchased without proof of concession will be accepted however memberships will not be fulfilled or posted until concession ID has been sighted by Membership Services.

Concession cards must have an expiry date.

8. Amendment of the Terms and Conditions

Melbourne Stars may vary these terms and conditions at any time.

Melbourne Stars will give notice of any amendments to these terms and conditions by:
email to the email address which you notified us of on the Registration Page or in any subsequent communication we receive from you updating your contact details; and
by posting the revised terms and conditions on melbournestars.com.au and gostars.com.au

Your continued registration as a member of Melbourne Stars after such notifications in clause 8 above will constitute acceptance by you of any amendments to the terms and conditions.

9. Indemnity

To the full extent permitted by law, you indemnify and will keep indemnified Cricket Australia, State Associations, Melbourne Stars and their directors, officers, employees, agents and corporate partners from and against all costs, losses, damages or expenses arising out of or connected in any way from your registration as a member of Melbourne Stars.

To the full extent permitted by law, all warranties, conditions and representations about Melbourne Stars or the products and services advertised, offered to be provided or provided to Melbourne Stars, are excluded. If a term is implied by law into these terms and conditions and the law prohibits provisions in a contract excluding or modifying liability under that term, then it shall be included in these terms and conditions. However, liability for a breach of such term will be limited, at Melbourne Stars sole option, to one or more of the following:

in relation to goods:

  • the replacement of the goods or the supply of equivalent goods;
  • the repair of such goods;
  • the payment of the cost of replacing the goods or acquiring equivalent goods; or
  • payment of the cost of having the goods repaired;
  • in relation to services:
  • the supply of the services again; or
  • the payment of the cost of having the services supplied again.

10. Technological Issues

Melbourne Stars is not responsible for any infection by computer virus, bugs, tampering, unauthorised intervention, fraud, technical failures or any other causes beyond the control of Melbourne Stars, including those that cause the delay or non-delivery of emails to and from Melbourne Stars. Melbourne Stars reserves the right to disqualify any individual who tampers with the registration process and to cancel his or her membership of Melbourne Stars.

11. General

This agreement is governed by the laws of Victoria. Each party submits to the non- exclusive jurisdiction of courts exercising jurisdiction there in connection with matters concerning this agreement.

No failure to exercise or delay in exercising any right, power or remedy by Melbourne Stars under this agreement operates as a waiver of that right, power or remedy by Melbourne Stars.

Any provision of this agreement that is prohibited or unenforceable in any jurisdiction is ineffective as to that jurisdiction to the extent of the prohibition or unenforceability. That does not invalidate the remaining provisions of this agreement or affect the validity or enforceability of that provision in any other jurisdiction.

The Melbourne Stars membership card and e-ticket/s remains the property of Melbourne Stars and may not be sold, exploited for commercial use, used for promotional or advertising purposes without the express written permission of Melbourne Stars.

Memberships are non-refundable. Once a Melbourne Stars membership has been purchased, Melbourne Stars is under no obligation to provide a cancellation or refund, except where required by law or in accordance with these terms and conditions.

Entry to matches is subject strictly to capacity. Membership holders are not guaranteed entry to a match, except where a reserved seat has been purchased (nb: if such reserved seating is a membership option).

The member is responsible for notifying Melbourne Stars should their details change, including the withdrawal of concession status, contact details or any other relevant information that could affect the member's membership with Melbourne Stars.

The membership is purchased for the BBL|05 season only. The price of a BBL|05 membership will not be reduced on the basis that an applicant wishes to take up a membership at any point once the season is underway.

All membership prices are inclusive of GST.

Melbourne Stars will not accept any responsibility for membership cards or e-ticket/s that have been lost. Lost membership cards or e-ticket/s can be reported to members@melbournestars.com.au and will incur a replacement fee. Members who have their membership card or e-ticket/s stolen or destroyed may be required to supply Melbourne Stars with a statutory declaration to that effect. Replacement cards or e-ticket/s cannot be issued on the day of a match.

Melbourne Stars reserves the right to refuse an application. Melbourne Stars also reserves the right to suspend or cancel a membership, without refund, to any member in breach of these terms and conditions.

This agreement constitutes the entire agreement between Melbourne Stars and you as to its subject matter.

Membership pack items are not guaranteed and are provided on a while stocks last basis. Whilst the Melbourne Stars will endeavour to provide all package items to members, if stock run out some items might not be included in the membership packs.

PREMIUM RESERVED AND GENERAL ADMISSION MEMBERSHIP SEATING TERMS & CONDITIONS

1. General Members Reserved and General Admission Seating Terms & Conditions

Melbourne Stars reserves the right to increase prices and/or to determine and change the price category of seats at its discretion. Melbourne Stars reserves the right to re-configure or change the seating layout and or the bay/stand design in conjunction with Stadium Management as required. Melbourne Stars is not obligated to notify or seek approval from seat holders to make changes to seating or surrounding areas.

Stadium seating remains the property of Stadium Management and is made available to Melbourne Stars to offer a renewal/lease arrangement to members on a year by year basis for Melbourne Stars home games only. Season seat holders do not hold any rights to access their season seat for any other events or games apart from home games as specified by Melbourne Stars within the Big Bash League season.

100% viewing of the game and arena is not guaranteed from any category of seating. Any seat classified as Restricted Viewing will be determined by Melbourne Stars with any such seat being charged at the standard price category of that location, or being charged an otherwise predetermined amount, at the Melbourne Stars discretion. Any seat classified as either undercover or underneath a roofline does not guarantee protection from the elements.

Seat holders are required to purchase a membership for every season seat held/renewed. Memberships therefore must be paid for at the time of purchase.

By renewing (making payment) of season seats in any year, members are agreeing to all of the terms of season seating and/or seating change requests as displayed on the Melbourne Stars website melbournestars.com.au and gostars.com.au and as updated from time to time. Each member should review these terms prior to the renewal process.

2. Members Reserved Seating Renewals

Renewal Notifications

Season seating renewals are offered subject to availability and Melbourne Stars will endeavour to offer a season seat renewal in each year to those who have held season seats in the previous year. This offer will however be at the discretion of Melbourne Stars and is not guaranteed with Melbourne Stars reserving the right to these seats at all times. Should the Melbourne Stars not be able to offer a seat renewal, the option of alternative seating may be offered at Melbourne Stars discretion. Renewal notifications for membership and season seats will be sent to the registered address. It is the responsibility of the member to follow up renewal forms which may not have been received and to ensure the Melbourne Stars has correct contact details at all times.

Renewal Due by Date

The renewal due by date for seats will be 31st July 2015, and may vary from year to year. Members will not receive personal renewal reminders or follow ups via mail, email or telephone if seats have not been renewed after the due date. Failure to renew season reserved seats by the specified due date in each year will forfeit the member's right of renewal.

Late Renewals

The acceptance of any late renewal will be determined solely by Melbourne Stars. In such cases where late renewals are offered, late fees may be applicable. Alternatively if a late renewal is not accepted, members would be required to re-apply for seating as a new applicant.

3. Premium Reserved Members Seating Applications

Premium Reserved Membership Transfers

Season seats can only be transferred to another existing or new member in the case of bequeath upon the death of an existing member or at the discretion of Melbourne Stars. If a seating transfer is granted, transfers requests must be received in writing and the appropriate renewal fee paid by the specified due date. Seat transfers will not be accepted after the renewal due date.

Seat Swaps

Seat changes and upgrades will be made available to renewing members subject to availability. To be eligible for a change of seating members must apply for this at the time of renewing. These applications will be accepted subject to any terms as stipulated on the membership information located on melbournestars.com.au and gostars.com.au and only up until the renewal due date. Seat changes are available on a one for one basis only. Members cannot transfer a seat to another person/member and then apply for a seat change. Once a seat is transferred the original seat holder no longer holds renewing seat holder rights and as such is required to apply for seating as a new seat applicant. Members who have received a seat via a transfer are not eligible in the year of transfer to apply for a seat swap. Members wishing to be processed as a group swap must lodge all applications together. After lodgement, if additional members wish to join a group swap the original application will become invalid and a new application number will be issued according to the date of the lodgement of the last member. Amendments to an application will not be accepted after the due by date or once an application has been processed. Changes to seating requirements on an application i.e. location or category will be accepted prior to processing providing this request has been received by Melbourne Stars in writing.

New Seats

Subject to seating availability Melbourne Stars will offer the option for existing members or new members to apply for season seats. Applications may be made available during the renewal period or alternatively seats may be released for sale on a specified date as advised by the Melbourne Stars. Allocation of such seating will be subject to availability and determined by Melbourne Stars based on the application details provided. Correspondence will not be entered into with seat applicants at the time of allocation of seats unless clarification of the application is required by Melbourne Stars.

New applicants may be required to wait until 1st August 2015 before they are allocated a seat for the upcoming season. Payment for the seat and membership is required at the time of application. Members wishing to be processed as a group must lodge all applications together. After lodgement, if additional applicants wish to join an existing application the application will firstly only be accepted if Melbourne Stars is in the process of accepting new applications. Secondly the original application number will become invalid and a new application number will be issued. This number will be issued according to the date of the lodgement of the last applicant. Amendments to seating requirements on an application i.e. location or category will only be accepted prior to processing providing this request has been received by Melbourne Stars in writing. The acceptance of a new application for seating does not guarantee that Melbourne Stars will be able to fulfil this application/request for seating. Refunds will be offered to seat applicants whom Melbourne Stars are unable to assist.

4. Junior Members

Children must be aged 5-15 years as at 1st December in the current membership year to be eligible for junior priced seating. A date of birth must be supplied for all junior seat applicants ID must be presented at the match if requested to confirm date of birth.

Please note that if a parent/guardian purchases a Premium Reserved Seat membership for their child, there will not be a reserved seat next to the child for the parent without also purchasing a reserved seat membership. If you only wish to purchase a Reserved Seat for your child (& not yourself), but wish to sit together, the child will need to sit in a General Admission area with you.

Children under five (5) years old are not required to have a seat purchased for them, however they must not occupy a seat and will need to sit on the lap of a parent or guardian. The child is not permitted to sit in aisles or run/move around to the detriment of other attendees. If you wish to purchase a season seat for a child under five (5) years old then a junior membership must be purchased and a Statutory Declaration must be provided indicating that this child will be the only person utilising the seat.

2 Game and Star Gazer members will have access to:

  • Autograph and Training Session
